Terms and Conditions

In these conditions, the provisions are discussed which are applicable to any use that the User makes of the services of Dizizid. User is advised to carefully take these Terms of Use into consideration so he knows what his rights and obligations are when he uses the services. By using the services, in any way, the User expressly agrees to be bound by these Terms of Use.

1. Definitions

In these terms of use, the following terms are used with an initial capital letter. These terms are defined as:
1.1 Event Organizer: Party hosting an event and who sells tickets to access to the event.
1.2 Event: organized event, including but not limited to an artistic, sports, theatrical and/or music events/performances, concerts and musicals.
1.3 User: the natural person and/or legal entity using the Ticket shop.
1.4 Terms of Use: these terms for the use of the Ticket shop.
1.5 Intellectual Property Rights: intellectual property rights and related rights to, but not limited to, copyrights, trademarks, all patents, design rights, trademarks, service marks, know-how, database rights and other rights in the nature of intellectual property rights.
1.6 Service costs: costs charged by Dizizid to User for using the Ticket Shop.
1.7 Ticket: admission ticket for an event.
1.8 Ticket shop: the Dizizid service which offers the User the option to purchase tickets and / or reserve tickets at Event Organizers.
1.9 Dizizid: the general partnership Dizizid VOF residing at Beneluxlaan 633, 1363 BJ Almere, registered at the Chamber of Commerce under number 59309857, VAT number NL853415833B01

2. Applicability

2.1 These Terms of Use apply to any use of the Ticket shop by the User.
2.2 The saved version of the communication with the User that is saved by Dizizid counts as proof of the applicability of the Terms of Use, thereof subject to counter proof by the User.
2.3 Electronic communication is deemed to have been received on the date of dispatch, unless the contrary is proved by the recipient. If the communication is not received as a result of delivery and / or accessibility problems regarding the mailbox of the User, this is at the User's risk, even if the mailbox is hosted by a third party.

3. Use of the Ticket shop

3.1 The Ticketshop provides a platform that makes it possible to purchase a ticket at an Event Organizer. Dizizid only delivers the ordering process of the tickets. The agreement to purchase the tickets is established between the User and the respective Event Organizer. Dizizid acts solely as an agent and has no interference in the purchase agreement between User and Event Organizer. These Terms concern only the agreement between Dizizid and the User to use the Ticket Shop.
3.2 Dizizid points out to the User that the Event Organizer has the legal obligation to ensure that the tickets corresponds to the purchase agreement between the User and the Event Organizer.
3.3 If the user wants to order a ticket, he must go through the ordering process. During the ordering process, the User must provide certain information necessary for the Ticket shop. User guarantees that this information is accurate, current, and correct.
3.4 Within the ordering process the user has the opportunity to make changes to the information previously given by him.
3.5 If the user used the Ticket shop to purchase a ticket at an Event Organizer, User can download the ticket directly from the Ticket shop. Users receive a confirmation of the fact that they can download the ticket through the email address provided by the User within 30 minutes. This confirmation also provides the user the ability to print the ticket again.
3.6 The information, as meant in Article 3.3 and 3.4, regarding the order and downloading of a ticket by the User is stored by Dizizid.
3.7 If the User has complaints about the use of the Ticket shop, for instance that problems have occurred with the operation of the Ticket shop, the user may get in touch with Dizizid trough support@dizizid.com. Dizizid will respond by e-mail on the complaint submitted by the User at the email address specified by the user.
3.8 User accepts that additional conditions may apply to the use of tickets as well as access to Events of Event Organizers. As stated in article 3.1 Dizizid is not responsible for these additional conditions and therefore accepts no liability for any damage suffered by the User as a result of the detailed conditions.
3.9 Dizizid points out to the User that the Ticket shop relates to leisure activities as referred to in Article 6:230p sub e BW so that user is not entitled to terminate the agreement without giving reasons as referred to in Article 6:230m paragraph 1 sub k BW. Even if the Ticket shop does not relate to leisure activities, User may not terminate the contract because the service towards the Ticket shop is directly performed with the consent of the User. Pursuant to Article 6:230m paragraph 1 sub k and 6:230p sub d BW, the user in this case, has no ability to terminate the contract without giving any reason.
3.10 The information on Tickets and Events, including information on the availability of tickets as well as dates, changes and cancellations of events, comes from the Event Organizer and not Dizizid. Dizizid has no influence and no involvement with this information and the accuracy of the information. Dizizid cannot guarantee the information is correct. Dizizid therefore accepts no liability for any damage that User suffers as a result of the unavailability of tickets and / or otherwise inaccurate and / or false information of Event Organizers. Dizizid also accepts no liability for damages caused by cancellation or postponement of an Event and the quality of the Event and / or the location where the Event is held.
3.11 User may only use coupons and / or vouchers if the possibility to do so is expressly given during the ordering process and the corresponding coupons and / or vouchers are issued by an authority that is accepted by Dizizid.

4. Disclaimer of warranties

4.1 The User acknowledges that the Ticket shop only contains the functionality and other features as he finds in the Ticket shop at the time of use ("as is"). Dizizid excludes express and implied warranties, undertakings and warranties of any kind, including but not limited to, warranties, undertakings and warranties regarding the quality, safety, legality, integrity and accuracy of the Ticket shop.
4.2 User shall indemnify Dizizid of claims by third parties based on the proposition that the activities carried out by the User with the help of the Ticket shop are in any way unlawful.
4.3 User guarantees that when using the Ticket shop (i) no robots, spiders, scrapers will be used and that no other applications will be used to use the Ticket shop other than intedend actions (ii) no applications that monitor or copy the Ticket shop will be used.

5. Payment

5.1 The User will pay the by the Event Organizer mentioned prices in the Ticket shop for the ticket. To use the Ticket shop service costs will be charged. The service costs are additional to the price of the Ticket.
5.2 The Service costs are compensation for the use of the Ticket shop by the User and are charged per sold ticket and per transaction. These service costs are directly charged to the User by Dizizid. All amounts are specified in the Ticket shop and include VAT unless stated otherwise. The prices quoted are subject to change without notice. The price stated in the order process is binding.
5.3 Dizizid accepts no liability regarding mistakes in ordering Tickets, for instance with regard to the number of tickets and / or type of event. It is not possible to cancel or exchange tickets at Dizizid. Furthermore Dizizid does not provide any refunding of tickets. Regarding these issues Dizizid refers to the Event Organizer as responsible and seller of the ticket.
5.4 If the Event Organizer has decided to refund the amount paid for a ticket, it never concerns the service costs. User service costs can only be refunded under article 10.2 defined conditions.

6. Cancelled or postponed events

6.1 Dizizid is not liable for compensation or refund of entrance fees in case of postponement or cancellation of an Event by the Event Organizer, or by the owner of the location.
6.2 If an Event is canceled or postponed, the user can return the Tickets for this Event under the regulation as defined by the Event Organizer. For the relevant conditions please refer to the Terms and Conditions of the Event Organizer. Service and handling fees are non-refundable.

7. Interruption Ticket shop

7.1 Dizizid does not guarantee that the Ticket shop will be accessible all the time and without interruptions or malfunctions. Faults can partly, but not exclusively, occur as a result of failures in the internet or telephone connection or by viruses or faults / defects. Dizizid is in no way responsible or liable for damages towards the User for any damages arising out of or resulting from (temporarily) unavailable or (interim) failure of the Ticket shop.
7.2 Dizizid is entitled, without prior notice and without being thereby responsible for damages to the User to (temporarily) decommission and / or limit its use of the Ticket shop if necessary in its opinion, for example in case of necessary maintenance of the Ticket shop.
7.3 Dizizid is entitled to make changes and / procedural and technical changes or improvements to the Ticket shop, without any prior notification.

8. Intellectual Property Rights

8.1 The Intellectual Property Rights relating to the Ticket shop, including any Intellectual Property Rights to the texts, images, design, photographs, software, audiovisual material and other material rests with Dizizid, its licensors and / or the Event Organizers.
8.2 Nothing in these Terms of Use is intended to transfer any Intellectual Property Rights to User. The use of the Ticket Shop by the User is limited to what is described in these Terms of Use. The User shall not perform any acts which infringe the Intellectual Property Rights of Dizizid, its licensors and / or Event Organizers, such as registering domain names or trademarks which are similar or identical to any object which Dizizid, its licensor (s) and / or the Event Organizers can claim Intellectual Property Rights on.

9. Privacy

9.1 While using the Ticket shop, User will provide (personal) data to Dizizid. This (personal) data will be stored and processed in accordance with the applicable laws and regulations and will, without prior permission, not be disclosed to third parties unless Dizizid is legally obliged to do so, or in defense of its rights.

10. Liability

10.1 Dizizid accepts no liability for damages resulting from the granting of the Ticket shop, misdemeanor or otherwise, to the extent permitted by mandatory law.
10.2 As far Dizizid is liable despite the provisions of Article 10.1 for damages arising under Article 10.1, the amount of compensation will be limited to the use of the Ticket charged service.
10.3 User shall indemnify Dizizid for all claims of third parties, on any grounds whatsoever in respect of compensation of damage, costs or interest in connection with or arising from his irregular use of the Ticket shop and / or any breach of these Terms of Use, and / or any other third party rights.
10.4 These limitations of liability conditions however, is not intended for Dizizid regarding the liability for intent and / or deliberate recklessness of Dizizid ("own actions") itself and / or exclude its managerial subordinates.

11. Miscellaneous, applicable law and competent court

11.1 The Terms of Use and the use of the Ticket is subject to Dutch law.
11.2 All disputes between the User, if this is a consumer, and Dizizid will be submitted to the competent court in the district of the domicile of the User, unless mandatory law provides otherwise. In the case of disputes between the User, other than a consumer, and Dizizid all disputes will be submitted to the competent court in Amsterdam.
11.3 In case these Terms of Use become partially invalid, User and Dizizid remain bound to the remaining sections. Dizizid will replace the void part by provisions that are valid and have legal consequences, given the contents and purpose of these Terms of Use, these correspond with those of the void part as much as possible.
